1. Introduction

Welcome to Rosella Adventures ("we", "our", "us"). By booking and participating in our birding day tours, you ("customer", "participant") agree to the following terms and conditions. Please read them carefully.

2. Booking and Payment

2.1. All bookings must be made through our website or over the phone.
2.2. Full payment must be made at the time of booking.

3. Cancellations, Refunds and Alterations

3.1. Cancellations made by the customer 30 days before the tour date will receive a full refund.
3.2. Cancellations made less than 30 days but more than 7 days before the tour date, a 50% refund will be given.

3.3. Cancellations made less than 7 days prior to the tour commencing will not be given a refund.

3.4. If we cancel a tour due to unforeseen circumstances (e.g., weather conditions), a full refund or alternative date will be offered.

3.5. Tour dates can be changed free of charge, subject to availability.

3.6. Force Majeure: Sometimes things happen that we just can't control, like natural disasters, wars, strikes, or government regulations. If any of these things prevent us from running the tour, we can't be held responsible for delays or cancellations.

4. Participation, Health and Safety

4.2. Our guides are here to keep you safe and ensure you have a great time, so please follow their instructions.

4.3. We want everyone to have a safe and enjoyable experience. If we feel someone isn’t fit for the tour or poses a risk, we might ask them to sit this one out.

5. Liability

5.1. We do our best to keep everyone safe, but we can’t be held responsible for any loss, damage, injury, or death that happens during the tour.

5.2. It’s important to follow the guide’s instructions. We aren’t responsible for any issues that come up if instructions aren’t followed.

5.3. Sometimes things happen that are beyond our control. We can’t be held liable for any loss, damage, injury, or death in these cases.

5.4. Insurance: We strongly recommend getting travel and cancellation insurance. We can't cover insurance costs, loss of deposits, airline cancellations, delays, or penalties for non-refundable tickets or other expenses related to tour preparations. If a tour is cancelled, we can’t cover insurance costs either.

6. Bird sightings

6.1 Birds are wild animals, and although we will do our absolute best to find your target bird species, sightings cannot be guaranteed. Rosella Adventures cannot be held responsible if you do not see a particular species.

6. Privacy Policy

6.1. We collect and use your personal information to process bookings, communicate with you, and improve our services. We only share it with trusted partners or as required by law. We protect your data and you can access, update, or delete your information and opt out of promotions. Please contact us to do so.

7. Tour Prices

7.1. Our tour prices are based on local costs at the time of planning and may be adjusted if there are significant changes.

7.2. Included in the Tour Price: The specifics of what's included in each tour are outlined in the itinerary. Generally, it covers all travel arrangements listed in the itinerary, tour materials, and the services of our tour guides.

7.3. Not Included in the Tour Price: The tour price does not cover expenses before the official start or after the end of the tour, travel insurance, passport, vaccination, or visa fees, excess baggage charges, airport taxes, meals and drinks on the tour. It also excludes drinks (except those provided), snacks, laundry, telephone calls, private excursions, tips, and any other personal expenses. Any additional expenses from arriving or departing outside of the tour's official times are also not included.

8. Governing Law

8.1. Our terms and conditions follow the laws of Queensland, Australia.

8.2. If any disputes come up, they'll be handled exclusively by the courts in Queensland, Australia.

9. Changes to Terms and Conditions

9.1. We may update or change these terms and conditions at any time.

9.2. Any updates will be posted on our website and will take effect right away.
